PRIVACY POLICY

Your privacy is important to BPLE LLC d/b/a Biya (“we”, “us,” “our” or the “Company”). We want you to be familiar with how we collect, use, share and disclose information. This Privacy Policy describes our practices in connection with any Personal Information of users of our social media sites, websites and/or mobile applications owned by us (collectively, the “Sites”, singularly, a “Site”). This Privacy Policy applies to our Sites and other services operated by us, which we refer to as our service (“Service”). By providing Personal Information to us or using the Sites or our Service, you agree to the terms and conditions of this Privacy Policy.

Personal Information We May Collect
We may collect Personal Information about you when you visit our Sites or use our Service. We may collect Personal Information about you from other sources, such as from publicly available sources or when you interact with us through social media.

INFORMATION WE COLLECT FROM YOU

In order to use our Service, you will be required to set up an account and establish a profile. This will require you to provide certain Personal Information to us, including your:

  • Login Credentials
  • First & Last Name
  • Zip code
  • Email address
  • Phone number
  • Birthday
  • Usage Data
  • Details on your personality, interests and other information about you,
  • Content such as photos and/or videos of you, which may require us to access your camera or photos.
  • Racial or ethnic origins, sexual orientation or dating/social preferences and religious beliefs.

By providing this information to us, you consent to having us process that information.
If you subscribe to a paid Service or make purchases from us, you may provide us or our payment service providers with information, including your credit card number, bank details or other financial information.
If you respond to surveys or the like, you provide us with information relating to our products and services.
If you participate in any events or promotions that we sponsor, you provide us with information necessary for you to register for the event/promotion.
If you contact our service associates, you provide us with information to help assist you.
When using our Service or Sites, you engage in and/or provide communications or “chats” to other users, which we may process on your behalf.
When using our Service or visiting our Sites, Usage Data is collected automatically. Usage Data may include information such as your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our Site, or when you access the Service by or through a mobile device.

When you use our Service or visit our Site, in order to provide the Service to you, we may collect the following information, with your consent:

  • Information regarding your location
  • Information from your Device’s phone book (contacts list)
  • Pictures and other information from your Device’s camera and photo library (this is necessary of you want to publish a video, photo or streaming in connection in connection with the Services)

We use this information to provide features of our Service, and to improve and customize our Service. The information may be uploaded to our servers and/or a service provider’s server or it may be simply stored on your device.
You can enable or disable access to this information at any time, through your device settings.

Information We Receive From Third Parties

We may receive information about you from third parties who provide such information to us. This includes information about you from other users of our Service.
We also may receive information about you from third party social media sites, such as Google, Facebook or Twitter. For example, you may be able to use your social media accounts to log in to our Sites and/or access our Service. If you decide to register through or otherwise grant us access to a third party social media service, we may collect personal data that is already associated with your third party social media service’s account, such as your name, your email address, your activities or your contact list associated with that account. You may also have the option of sharing additional information with us through your third party social media service’s account. If you choose to provide such information and personal data, during registration or otherwise, you are giving us permission to use, share, and store it in a manner consistent with this Privacy Policy.

How We May Collect Personal Information

We and our service providers may collect Personal Information in a variety of ways, including, in addition to methods outlined above:
Through our Sites: We collect Personal Information when you provide it to us through the Sites such as when you create an account and/or profile with us or utilize our Sites and/or the Service.
From Other Sources: In addition to the above, we may receive your Personal Information from other sources, such as when you participate in surveys, provide feedback, connect with us through social media, or send us emails.

How We Use Personal Information

We use Personal Information to facilitate, use, deliver and improve the Service. We also use Personal Information to provide you with advertising and/or marketing information that may be of interest to you. We may do this by sending you emails, messaging to your accounts, mobile phone calls and/or text messages. Our use includes the following:

  • To Provide And Improve The Services To You. This includes setting up and managing your account and delivery of the Service, facilitating transactions, communicating with you about the Services and Sites, providing you with newsletters and/or promotions, providing you with customer support, responding to your inquiries, sending you information regarding the Sites, changes to our terms, conditions and policies and other administrative information, improving the Service, and to link your devices, accounts and browser data.
  • To Connect You With Other Users. This includes analyzing your profile and preferences and those of others and otherwise helping to provide the Service to you and to help you make connections to others.
  • To Help Fight and Prevent Fraud or Other Illegal Activities. This includes retaining and analyzing data.
  • To Help Ensure Legal Compliance. This includes assisting law enforcement, complying with legal requirements and enforcing our terms and conditions.

6. How AND WHEN Personal Information is Shared or Disclosed

Our Service is meant to help you make connections with other users and to facilitate those communications. This, of course, requires us to share user’s Personal Information with other users and/or some third party providers who help us operate the Site and/or provide the Service.
We do not sell your Personal Information. However, your Personal Information may be shared or disclosed:

  • To other users, to facilitate the Service. Your information is shared with other users when you create your profile. The content about you that you share will be public and you agree that others will be able to see the content you provide. You may choose to limit the viewers of your information in your settings.
  • To our third party service providers who provide services such as hosting, data processing and analysis, information technology, email delivery, auditing services, payment processing services, order fulfillment and delivery services, marketing services, and other similar services.
  • By you, on message boards, chat, profile pages, blogs and other services to which you are able to post information and materials. Please note that any information you post or disclose through the Service or Sites will become public and may be available to visitors to the Site. We urge you to be very careful when deciding to disclose your Personal Information, or any other information, on the Site.
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.
  • To the extent information does not specifically identify you, such as aggregated statistical information about your use of the Sites and/or products and/or services you used or purchased.
  • With our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
  • With business partners to offer you certain products, services or promotions.
  • With your consent. We may disclose your Personal Information for any other purpose with your consent.

Other Information We Collect
“Other Information” is any information that does not reveal your specific identity or does not directly relate to an individual, such as:

  • Browser information
  • App usage data
  • Information collected through cookies, pixel tags and other technologies
  • Demographic information and other information provided by you
  • Aggregated information
  • Internet protocol (IP) addresses
  • Device operating system information
  • Mobile device identifier information and serial numbers

 

8. How We Collect Other Information

We and our third party service providers may collect Other Information in a variety of ways, including:

  • Through your browser or device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version, device manufacturer and model, language and Internet browser type and version. We use this information to ensure that the Site functions properly.
  • Through your use of the app: When you download and use the app, we and our service providers may track and collect app usage data, such as the date and time the app on your device accesses our servers and what information and files have been downloaded to the app based on your device number.
  • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, language preferences and other anonymous traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while visiting the Site, as well as for online tracking purposes. We also use cookies to gather statistical information about the use of the Sites in order to continually improve its design and functionality, understand how it is used and assist us with resolving questions about it. Cookies further allow us to select which of our content, advertisements or offers are most likely to appeal to you and display them while you are on the Sites. We may also use cookies in online advertising to track responses to our advertisements.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies or be given the choice of declining or accepting the transfer to your computer of a particular cookie (or cookies) from a particular site. You may also wish to refer to http://www.allaboutcookies.org. If you choose to decline cookies, you may experience some inconvenience in your use of the Sites, and some or all of the features, functionality and promotions available through the Sites may not be available to you.

We use Google Analytics, which uses cookies and other, similar technologies to collect information about Site use anonymously and reports website trends, without identifying individual visitors. We also use an enhancement to Google Analytics called “Demographics and Interest Reporting,” through which Google provides us with information about Site users’ demographics (e.g., age, gender) and interests. This information, which Google may collect by tracking a user’s behavior across third-party websites, helps us to learn more about our users. You can learn about Google’s practices in connection with this enhanced tracking and opt out of it by visiting www.google.com/settings/ads or by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

  • Using pixel tags and similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Site pages and HTML-formatted email messages to, among other things, track the actions of Site users and email recipients, measure the success of our marketing campaigns and compile statistics about Site usage and response rates.
  • IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP Address may be identified and logged automatically in our server log files whenever a user visits the Sites, along with the time of the visit and the page(s) that were visited. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems and administering the Site.
  • Physical Location: We may collect the physical location of your device by, for example, using satellite, cell phone tower or WiFi signals. We may use your device’s physical location to provide you with personalized location-based services and content. We may share your device’s physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with more personalized content and to study the effectiveness of advertising campaigns. You may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you choose to do so, we and/or our marketing partners may not be able to provide you with the applicable personalized services and content.
  • From you: We collect other information, such as your preferred means of communication, when you voluntarily provide it. Unless combined with Personal Information, this information does not personally identify you.
  • By aggregating information: Aggregated Personal Information does not personally identify you (for example, we may aggregate Personal Information to calculate the percentage of our users who have a particular telephone area code).

9. How We Use and Disclose Other Information

If we are required to treat Other Information as Personal Information under applicable law, then, in addition to the uses listed in the “How We Collect Other Information” section above, we may use and disclose Other Information for all the purposes for which we use and disclose Personal Information.
In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

 

10. THIRD PARTY SITES

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site to which this Site contains a link. The inclusion of a link on the Sites does not imply endorsement of the linked site by us or by our affiliates.

 

11. Security

We use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contact Us” section below.

12. CHOICES AND ACCESS

Your choices regarding our use and disclosure of your Personal Information

We give you choices regarding our use and disclosure of your Personal Information for marketing purposes. You may opt out from:

  • Receiving marketing emails or text messages from us: If you no longer want to receive marketing emails or text messages from us, you may opt out of receiving them by following the instructions contained in each such email or text message. If you opt out, we may still send you important administrative messages.
    We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out as described above, we may not be able to remove your Personal Information from the databases of our affiliates.

How you can access, change or suppress your Personal Information
If you would like to review, correct, update, suppress, delete or otherwise limit our use of the Personal Information you have provided to us, you may access your online profile and other personal details through the Sites, so that you can update them yourself. You can also do it by contact us by writing to support@biya-app.com
In your request, please make clear what information you would like to have changed, whether you would like to have your Personal Information suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Information. We will try to comply with your request as soon as reasonably practicable. For your protection, we may only implement requests with respect to the Personal Information associated with the email address you use to send us your request, and we may need to verify your identity before implementing your request.
Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to your request. There may also be residual information that will remain within our databases and other records, which will not be removed.

 

13. RETENTION PERIOD

How long we keep the information we collect about a customer depends on certain factors. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. In addition, if you have elected to receive marketing emails from us, or have not opted-out of receiving such materials, we retain information for a reasonable period of time from the date last expressed interest in our Service, such as when the customer last opened an email from us or ceased using our Service. After such time, we will either delete or anonymize the information or, if this is not possible (for example, because the information has been stored in backup archives), then we securely store the information, isolate it from any further use and then finally delete. We do not share, sell, rent, or trade any customer or user information with third parties for their promotional purposes.

14. Use of THE site by CHILDREN

We are committed to protecting children’s privacy. Our Sites and our Service are not intended for children under 13 years of age and no one under age 13 may provide any Personal Information on the Sites. We do not knowingly collect Personal Information from children under 13. If you believe we might have any information from or about a child under 13, please contact us at support@biya-app.com
and provide us sufficient detail to investigate the matter and take corrective action.  For more information about the Children’s Online Privacy Protection Act (COPPA), visit the FTC website: www.ftc.gov.
We ask parents to regularly monitor and supervise their children’s online activities.

15. JURISDICTIONAL ISSUES
The Sites are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.

16. CROSS-BORDER TRANSFER
Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using the Sites, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

17. SENSITIVE INFORMATION
we ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., Social Security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health or criminal background) Ion or through the Sites or otherwise to us.

18. RESIDENTS OF CALIFORNIA
California residents can request a notice disclosing the categories of your Personal Information that we have shared with third parties for their direct marketing purposes during the preceding calendar year. If you wish to request this information, please do so to support@biya-app.com. It may take up to 30 days for us to respond. To protect you, we ask that you provide proof of identity.

19. CCPA Privacy
This privacy notice section for California residents supplements the information contained in our Privacy Policy and it applies solely to all visitors, users, and others who reside in the State of California.

Categories of Personal Information Collected
We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Device. The following is a list of categories of personal information which we may collect or may have been collected from California residents within the last twelve (12) months.
Please note that the categories and examples provided in the list below are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact collected by us, but reflects our good faith belief to the best of our knowledge that some of that information from the applicable category may be and may have been collected. For example, certain categories of personal information would only be collected if You provided such personal information directly to Us.

Category A: Identifiers.
Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, driver’s license number, passport number, or other similar identifiers.

Under CCPA, personal information does not include:

  • Publicly available information from government records
  • Deidentified or aggregated consumer information
  • Information excluded from the CCPA’s scope, such as:
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data
  • Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from the forms you complete on our Service, preferences you express or provide through our Service.
  • Indirectly from you. For example, from observing your activity on our Service.
  • Automatically from you. For example, through cookies we or our Service Providers set on your Device as you navigate through our Service.
  • From Service Providers. For example, third-party vendors to monitor and analyze the use of our Service, or other third-party vendors that we use to provide the Service to You.

Use of Personal Information for Business Purposes or Commercial Purposes
We may use or disclose personal information we collect for “business purposes” or “commercial purposes” (as defined under the CCPA), which may include the following examples:

  • To operate our Service and provide you with our Service.
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our Service.
  • To fulfill or meet the reason you provided the information. For example, if you share your contact information to ask a question about our Service, we will use that personal information to respond to your inquiry.

When we disclose personal information for a business purpose or a commercial purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Sale of Personal Information

As defined in the CCPA, “sell” and “sale” mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for valuable consideration. This means that we may have received some kind of benefit in return for sharing personal information, but not necessarily a monetary benefit.
Please note that the categories listed below are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact sold or disclosed, but reflects our good faith belief to the best of our knowledge that some of that information from the applicable category may be and may have been shared for value in return.

Sale of Personal Information of Minors Under 16 Years of Age
We do not knowingly collect personal information from minors under the age of 16 through our Service, although certain third party websites that we link to may do so. These third-party websites have their own terms of use and privacy policies and we encourage parents and legal guardians to monitor their children’s Internet usage and instruct their children to never provide information on other websites without their permission.
We do not sell the personal information of Consumers we actually know are less than 16 years of age, unless We receive affirmative authorization (the “right to opt-in”) from either the Consumer who is between 13 and 16 years of age, or the parent or guardian of a Consumer less than 13 years of age. Consumers who opt-in to the sale of personal information may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by contacting us.
If you have reason to believe that a child under the age of 13 (or 16) has provided us with Personal Information, please contact Us with sufficient detail to enable us to delete that information.

Your Rights under the CCPA

The CCPA provides California residents with specific rights regarding their personal information. If you are a resident of California, you have the following rights:

  • The right to notice. You have the right to be notified which categories of Personal Data are being collected and the purposes for which the Personal Data is being used.
  • The right to request. Under CCPA, you have the right to request that we disclose information to you about our collection, use, sale, disclosure for business purposes and share of personal information. Once we receive and confirm your request, we will disclose to You:
    • The categories of personal information We collected about you
    • The categories of sources for the personal information we collected about you
    • Our business or commercial purpose for collecting or selling that personal information
    • The categories of third parties with whom we share that personal information
    • The specific pieces of personal information we collected about you
    • If we sold your personal information or disclosed your personal information for a business purpose, we will disclose to you:
      • The categories of personal information categories sold
      • The categories of personal information categories disclosed
  • The right to say no to the sale of Personal Data (opt-out). You have the right to direct us to not sell your personal information. To submit an opt-out request please contact us.
  • The right to delete Personal Data. You have the right to request the deletion of your Personal Data, subject to certain exceptions. Once we receive and confirm your request, we will delete (and direct our Service Providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our Service Providers to:
    • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
    • Debug products to identify and repair errors that impair existing intended functionality.
    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
